In these terms, Promotora Terra S.A.S. is referred to as "the Developer" and is the company responsible for the Site and the Project. Ítaca Tower (the "Project") is a housing project located in the Manga neighborhood, Cartagena de Indias, Bolívar, developed by the Developer and marketed under the Mejía Villegas brand. Mejía Villegas is the commercial brand that backs the Project; the obligations arising from transactions on the units belong to the Developer, under the terms of the documents you sign with it.
2. Purpose and acceptance
These terms govern access to and use of the Site. By browsing it, you accept these terms. If you do not agree with them, we ask that you not use the Site. The processing of your personal data is governed by the Personal Data Processing Policy published on the Site.
3. Informational nature of the Site
The Site presents the Project and makes it easy to contact the sales team. No property is sold and no payments are received through the Site. The information published does not, by itself, constitute an offer to sell any specific unit. The conditions of each transaction are set out in the quotation, the promise-to-purchase agreement and the other documents the Developer provides, without prejudice to the effects that the law attributes to advertising and to information provided to the consumer.
4. Prices
Prices are expressed in Colombian pesos and indicate a "from" value for the stated unit type and phase. They correspond to the price list in force as of October 10, 2026 and may change depending on availability, floor, unit location and Project phase. The price applicable to each transaction is the one set out in the quotation and the promise-to-purchase agreement.
Parking is included in the published price, according to the price list in force, and is governed by the conditions of the quotation.
5. Areas, unit types and specifications
Published areas are approximate, and we indicate whether they correspond to private built area or built area. The final areas, boundaries, technical specifications and finishes are those set out in the promise-to-purchase agreement, the specifications annex and the public deed. Published unit types are subject to availability.
6. Images, renders, 360° tours and model apartments
Images, renders, models, 360° tours and videos are digital representations of the design. Together with the properties shown in the sales room or model apartment, they may vary in how they are perceived and in their final construction. The furniture, decoration, staging and finishes shown are illustrative and are not part of the property, except for those included in the technical specifications you sign when you join the Project. Images of the surroundings, roads and third-party facilities are for reference.
7. Phases, construction progress and dates
The phases, construction status and dates published on the Site are informational and correspond to the time of their publication. The delivery dates applicable to each unit are those set out in the promise-to-purchase agreement.
8. Simulator and calculators
The Site’s simulator provides reference results calculated from the data you enter and from general rate and term assumptions. It does not constitute a credit offer, an approval or a quotation. The actual financing conditions depend on the review and approval of the financial institution you choose.
9. Financing, subsidies and benefits
Information about credit, leasing, subsidies, use of severance savings (cesantías), or benefits from financial institutions and family compensation funds is general. Their granting depends on the requirements, availability of funds and approval of each institution, not on the Developer. The Project’s commercial benefits have the validity period and conditions indicated in the specific piece or in the quotation.
10. Appreciation and investment
Any reference to appreciation or return on investment is informational and depends on market conditions. The Developer does not guarantee appreciation, profitability or future income from the purchase of a Project unit.
11. Third-party services
Services provided by third parties (financial institutions, trust companies, condominium management, real estate agencies, operators of local services or facilities) are the responsibility of each third party. Their mention on the Site does not imply that the Developer guarantees their results.
12. Promotions and Referral Program
Promotions and the Referral Program are governed by their own terms, published at https://mejiavillegas.com/wp-content/uploads/2026/10/PR-014-Plan-de-Referidos.docx-3-2.pdf, with their validity period, requirements and method of payment.
13. Use of the Site
You agree to use the Site lawfully, to provide truthful information in the forms and not to take actions that affect its operation or security. The Developer may suspend access to the Site for maintenance or for technical reasons.
14. Intellectual property
The brands, logos, project names, texts, photographs, renders, plans, videos and design of the Site belong to the Developer or to Mejía Villegas, or are used with the authorization of their owners. They may not be reproduced or used for commercial purposes without prior written authorization.
15. Links and third-party platforms
The Site may link to third-party platforms such as WhatsApp, YouTube, Vimeo, Google Maps, online scheduling tools or social networks. Use of those platforms is governed by their own terms and policies.
16. Liability
The Developer strives to keep the information on the Site correct and up to date. Before making your purchase decision, inform yourself at the sales room and with your sales advisor about the conditions and features of the Project. This clause does not limit the rights granted to you by Law 1480 of 2011 (the Consumer Statute).
17. Changes to these terms
The Developer may update these terms. The version in force is the one published on the Site, with its update date.
18. Language
The Site is published in Spanish and English. In the event of any discrepancy between versions, the Spanish version prevails.
19. Governing law and contact
These terms are governed by the laws of the Republic of Colombia. For inquiries, requests, complaints or claims, you may write to comercial@itacatower.com or visit the Project’s sales room.
