DATA CATEGORIES
Processing of personal data of children and/or adolescents. The processing of personal data of children and/or adolescents that is public in nature will meet the following parameters and requirements:
- It responds to and respects the best interests of children and adolescents.
- It ensures respect for their fundamental rights.
- It takes into account the minor's opinion when they have the maturity, autonomy, and capacity to understand the matter.
Once the above requirements are met, the legal representative of the child or adolescent may grant authorization for the processing, after the minor has exercised their right to be heard, an opinion that must be weighed taking into account their maturity, autonomy, and capacity to understand the matter. When necessary, MEVICONSA S.A. will give specific instructions to minors not to provide personal data.
Sensitive data: In order to provide our services, it is necessary to collect certain data that by its nature is considered sensitive data, that is, data that affects your privacy or whose misuse could lead to any kind of discrimination. Such data may include employment status, dependents, marital status, assets and liabilities, etc. (Art. 5, Law 1581/12). Processing of sensitive data: the processing of sensitive data is prohibited, except when:
- The data subject has given explicit authorization for such processing, except in cases where the law does not require such authorization.
- The processing is necessary to safeguard the vital interest of the data subject and they are physically or legally incapacitated. In these cases, their legal representatives must grant authorization.
- The processing is carried out in the course of legitimate activities and with due guarantees by a foundation, NGO, association, or any other non-profit body whose purpose is political, philosophical, religious, or trade-union, provided that it refers solely to its members or to persons who maintain regular contact with it by reason of its purpose. In these cases, the data may not be provided to third parties without the data subject's authorization.
- The processing refers to data necessary for the recognition, exercise, or defense of a right in legal proceedings.
- The processing has a historical, statistical, or scientific purpose. In this case, measures leading to the removal of the data subjects' identity must be adopted.
Likewise, the person in charge of data processing must inform the data subject of the following:
- Inform the data subject that, because the data is sensitive, they are not required to authorize its processing.
- Inform the data subject explicitly and in advance, in addition to the general authorization requirements for collecting any type of personal data, which of the data to be processed is sensitive and the purpose of the processing, and obtain their express consent.
No activity may be made conditional on the data subject providing sensitive personal data.
PUBLIC DATA: By public data we mean any data available in banks, databases, or other forms of data collection for PUBLIC USE; that is, data anyone can access without any special requirement. The same applies to personal data found in such sources, which will be considered public by nature, respecting the parameters imposed by law and the provisions above.
